Welcome to TheLapidaryOffice.com . These Terms of Service ("Terms") constitute a legally binding agreement between you and The Lapidary Office and govern your access to and use of our website, our online shop, our digital subscription vault, and all lapidary services (including mail-in faceting and custom services). By accessing or using any part of our service, you agree to be bound by these Terms, our Privacy Policy, and our Return Policy.
1. Service Description
The Lapidary Office provides the following services:
Online Shop: Sale of finished gemstones, cabochons, and resale gems.
Mail-in Lapidary Services: Professional cutting, shaping, and polishing of client-provided materials (rough stones) into finished cabochons, faceted gems, or other custom lapidary pieces, governed by the terms in Section 3.
Digital Subscription Vault ("The Vault"): Access to a members-only digital library featuring Gem Cut Studio (.gcs) design files, facet diagrams, and PDF downloads, available on a recurring monthly subscription basis.
2. User Conduct
You agree not to use our website or services for any unlawful purpose or in any way that violates these Terms. Acceptable conduct includes respectful communication when submitting custom requests or engaging with customer support. Prohibited conduct includes, but is not limited to:
Submitting materials known or suspected to be illegal, stolen, or containing hazardous substances.
Engaging in spamming, harassment, or abusive behavior toward The Lapidary Office, its staff, or other users.
Attempting to interfere with the proper working of the website or the security of the services.
Automated Scraping & Data Hoarding: Using automated systems, scripts, bots, spiders, extensions, or scraping software to mass-download, hoard, or systemically archive Digital Assets from The Vault. We actively monitor downloading activity; unusual or excessive download patterns may trigger an automatic account suspension for manual review and potential permanent termination without a refund.
3. Lapidary Service Agreement and Material Disclaimer
By engaging The Lapidary Office for any cutting, shaping, or polishing service, the client agrees to the following terms:
Acknowledgment of Process and Risk: The client understands and acknowledges that the lapidary process involves the permanent alteration and inherent destruction of the raw material provided. The material, once cut, cannot be returned to its original state.
Material Risk and Liability Waiver: * Risk of Loss or Damage: Cutting, grinding, and polishing gemstones carries a significant risk of fracturing, chipping, cracking, or complete destruction of the material due to hidden inclusions, internal stress, or unforeseen flaws within the stone.
Waiver of Claims: The client hereby absolves and releases The Lapidary Office, its owner, and its employees from any and all legal action, claims, damages, liabilities, or losses (including but not limited to the material's market value or replacement cost) resulting from the destruction, damage, loss, or unsuccessful completion of any material submitted for service.
Valuation: By submitting material, the client agrees that any liability on the part of The Lapidary Office is expressly limited to the exact cost of the lapidary service fee paid for that specific piece and will explicitly exclude the raw material's inherent value.
Consent to Proceed: The act of submitting material and accepting a Service Contract or invoice constitutes the client's full and informed consent to these terms, including the understanding that their material is being sent to be "destroyed into art."
Shipping Responsibilities and Transit Risk: The client is solely responsible for all shipping costs, packaging, tracking, and insurance fees when sending raw material to The Lapidary Office. The Lapidary Office is not liable for items lost, stolen, or damaged while in transit, whether inbound or outbound. It is highly recommended that clients purchase adequate shipping insurance. In the event of a transit loss, any insurance claims must be filed and managed by the client directly with the shipping carrier.
Abandoned Property Policy: Upon completion of the lapidary services, a final invoice for the balance and return shipping will be issued. If the client fails to make full payment or fails to provide a valid return shipping address within 90 days from the initial date the completion invoice was issued, the submitted material and finished goods will be legally deemed abandoned. The Lapidary Office reserves the right to sell the abandoned material to recover the costs of labor, storage, and materials, or to otherwise dispose of the property at its sole discretion, with no further liability or obligation to the client.
4. Payment Terms & Subscriptions
Shop Purchases: All payments for products are due at the time of order and are processed securely by third-party payment processors (e.g., PayPal, Stripe, Square). I do not store your financial data.
Lapidary Services: A deposit or full payment for custom services may be required upon accepting the Service Contract. Final payment for services and return shipping is required before the finished material is shipped back to the client. Payment is considered collected when the third-party processor confirms the funds have cleared.
Vault Membership Subscriptions: By signing up for The Vault, you authorize The Lapidary Office to charge your payment method on a recurring monthly basis at the then-current plan rate on the anniversary of your sign-up date. Upon successful registration, you will receive an electronic confirmation email detailing your subscription terms and cancellation path. If a payment fails, access to the protected Member Area will be automatically suspended until billing information is successfully updated. We reserve the right to adjust subscription pricing with at least 30 days’ notice; notice of any price adjustments will be sent to your registered email address. If you do not agree to the updated pricing, you must cancel your subscription prior to the next billing date; continued use of the service after the 30-day notice period constitutes full acceptance of the revised rate.
Taxes and Fees: All subscription fees listed on the website are exclusive of applicable sales tax, Value Added Tax (VAT), or other local digital goods consumption taxes. Any required taxes will be automatically calculated and added to your total at checkout based on your jurisdiction and billing location. You are solely responsible for all applicable taxes associated with your subscription purchase.
5. Digital Goods and Cancellation Policy
No-Refund Policy: Due to the immediate, downloadable nature of intellectual property, all sales of digital goods, single-design downloads, and monthly subscription payments are final and 100% non-refundable once access to the digital vault has been granted or files have been downloaded. By purchasing a subscription, you explicitly waive any statutory right of withdrawal or cooling-off periods.
Technical Software & File Requirements: To utilize the files provided within the digital subscription vault, you must have the necessary software and technical capabilities:
PDF Files: A compatible PDF reader is required to open and print faceting diagrams.
GCS Files: To view, open, or edit specialized .gcs files, you must have Gem Cut Studio (GCS) software installed. The Lapidary Office provides raw design files only and is not responsible for licensing, providing, or troubleshooting third-party software.
Content Modification and Availability: The Lapidary Office reserves the right to add, update, modify, or remove any digital assets, designs, faceting diagrams, or files from The Vault at any time, at our sole discretion, without prior notice. We do not guarantee that any specific design or file will remain available in the library indefinitely.
Subscription Cancellation (Opt-Out): You may cancel your subscription at any time directly through your customer account portal. To prevent the automated billing system from processing the next cycle's payment, cancellations must be completed before your next scheduled billing date.
No Retroactive Refunds: If you cancel your membership, you will maintain access to the protected Member Area until the end of your current paid billing period, at which point access will terminate. No partial or prorated refunds will be issued.
6. Account Management
Registration: If an account is required for service access, you agree to provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.
Termination by You: You may cancel your account or opt out of our services at any time by contacting us directly.
Termination by Us: We reserve the right to suspend or terminate your account and access to the services immediately if you breach these Terms or engage in illegal or harmful conduct.
Electronic Communications Consent: By creating an account, making a purchase, or providing your email address to The Lapidary Office, you explicitly consent to receive communications from us electronically. We will communicate with you by email or by posting notices on this website. You agree that all agreements, notices, disclosures, invoices, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
7. Intellectual Property & Digital Licensing
General Ownership: The content, design, logo, and all original material on TheLapidaryOffice.com—including all text, images, and the design of faceted gemstones or cabochons created by us (excluding the client's raw material)—are the exclusive property of The Lapidary Office. You may not use any content without our express written permission.
Digital Asset Licensing: All faceting diagrams, PDF files, and interactive .gcs files downloaded from The Vault remain the exclusive copyrighted intellectual property of The Lapidary Office. All designs are originally created by us and are not intentionally copied from any other source. Because certain geometric shapes and facet patterns are dictated by mathematical symmetry, any similarity between these designs and any existing or future designs is purely coincidental.
Permitted Use: Purchasing a membership grants you a single-user, non-exclusive, non-transferable, revocable license to use these designs to personally cut physical gemstones for personal enjoyment or for the commercial sale of the resulting physical stone. Your subscription grants you a temporary, revocable license to access the Digital Assets during your active billing cycle. It does not constitute a sale or transfer of intellectual property rights. Upon cancellation or termination of your subscription, your legal right to access the Vault and use any downloaded files for new projects immediately ceases, though stones already physically cut during an active subscription remain unaffected.
Prohibited Use: You are strictly prohibited from redistributing, sharing, reselling, renting, uploading, or republishing the digital files, coordinates, or diagram graphics themselves to any third party, external database, online forum, public database, or lapidary community.
Account Sharing: Subscription accounts are for single-user access only. Sharing account login details to bypass the paywall will result in immediate termination of service without a refund and potential legal action. To enforce single-user access, we monitor concurrent sessions. Accessing the Vault simultaneously from multiple geographic locations or distinct devices beyond a reasonable personal threshold may trigger an automatic security lockout. You are strictly responsible for maintaining the confidentiality of your credentials
8. Additional Disclaimers and General Terms
Accuracy of Website Information: While we strive to ensure accuracy, we do not warrant that product descriptions, pricing, or other content of the Online Shop are complete, reliable, current, or error-free. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice.
Third-Party Links: Our Service may contain links to third-party websites or services that are not owned or controlled by The Lapidary Office. We assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.
Force Majeure: We shall not be deemed in breach of this Agreement for any delay or failure in performance resulting from causes outside our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, labor disputes, shipping carrier failure, or natural disasters.
9. Liability and Disclaimers
Limitation of Liability: To the maximum extent permitted by law, The Lapidary Office shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the website or services (beyond the specific service fee limitation noted in Section 3).
Warranty Disclaimer: Our website and services are provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, whether express or implied.
Digital Design Disclaimer: Digital designs and PDF diagrams are provided on an "as-is" and "as-available" basis. While my designs are mathematically tested, success in lapidary depends heavily on individual machine calibration, index gear alignment, material characteristics, and user skill. The Lapidary Office does not warrant that files will be compatible with older versions of software, and holds no liability for raw mineral material ruined or lost during the cutting of these designs.
Website Uptime and Technical Limitations: While I strive to maintain consistent access to The Vault, I do not guarantee uninterrupted or error-free operation of my website or member portal. Access may be temporarily suspended without notice for scheduled maintenance, server upgrades, or due to unexpected technical outages, third-party hosting failures, or internet disruptions. Temporary downtime does not entitle subscribers to refunds, billing credits, or extensions of their current billing cycle.
10. Governing Law and Jurisdiction
This Agreement and your use of the Service shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law principles.
11. Dispute Resolution
Any legal action or proceeding arising under these Terms will be brought exclusively in the state or federal courts located in Phoenix, Arizona. By using the Service, you consent to the jurisdiction of these courts.
12. Updates to Terms
We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the Service after the revised Terms have been posted constitutes your acceptance of the changes.
